Unsurprising Cowardice (Leadership)

In February, Republicans said no to an Authorization for Use of Military Force specifically crafted to address Daa’ish because it wasn’t a big enough war. And while Republican presidential candidates might be lining up to take it out on Syrian refugees and Muslims both at home and around the world, the one thing they won’t do, according to Senate Majority Leader Mitch McConnell, is grant an Authorization for Use of Military Force against Daa’ish.

“The president obviously feels he has the authority now to do what he’s doing,” McConnell said. “And the discussions with Democrats on AUMF make it clear that the only kind of AUMF they would support is one that would include such micromanagement of the military exercise as how many troops you could have, how long they could stay, and all of this.

“I would not want to saddle the next president with a prescriptive AUMF. We’re going to have a new president a year from now,” McConnell continued. “He or she may have a different view about the way to deal with ISIS and that part of the world. I don’t think we ought to be passing an AUMF as the president exits the stage when he already thinks he has the authority to do what he’s willing to do now.”

This is a weird back and forth; as near as anyone can tell, the Obama administration is operating in the Levantine Theatre under the auspices of the same post-9/11 AUMF that saw President Bush invade Iraq. We are, essentially, living in the time of perpetual warfare authorized fourteen years ago.

The Szubin Question (Forty-Seven Rise Again Remix)

Perhaps some recall an occasion not so long ago when the United States faced such a potential health crisis that small-government conservatives, Republicans who purport to disdain the idea of an American czar, called for President Obama to appoint a new policy czar to deal with Ebola.

The White House, Democratic supporters, and many others pointed out that the Senate could start by simply confirming the nominated Surgeon General; Vivek Murthy’s nomination languished for over a year because Republicans objected to the idea that gunshot wounds are a health issue.

With a potential health crisis pitching Republicans into panic, they sought another executive-appointed czar, instead of confirming a qualified nominee to lead the uniformed service whose job it is to respond to public health threats.

The president already has a “czar” to deal with Daa’ish; his name is Brett McGurk, and last month he replaced Gen. John Allen (USMC, Ret.) as Special Presidential Envoy for the Global Coalition to Counter ISIL”, but he also needs his Undersecretary of the Treasury for terrorism and financial crimes, currently occupied as an interim appointment for over two hundred days because Senate Republicans refuse to slate his confirmation hearing.

Szubin’s nomination got a hearing before the Senate Banking Committee on Sept. 17, and Chairman Richard Shelby (R-Ala.) praised his past work in countering terrorist financing during his time with both Republican and Democratic administrations.

“He is eminently qualified for this,” Shelby said at the time.

But Szubin’s nomination hasn’t moved since. There’s no clear reason why, beyond trying to make it difficult for President Barack Obama to fill administration posts.

“Treasury must have in place an experienced watchdog, with the know-how and authority to lead U.S. efforts to track and choke off the financial lifeblood of terrorist organizations,” Sen. Sherrod Brown (D-Ohio), the top Democrat on the Banking Committee, said Wednesday. “Republicans in Congress need to stop holding our national security apparatus hostage to political demands, and allow Adam Szubin and other national security nominees to be approved as soon as possible.”

A Shelby spokeswoman did not respond to a request for comment.

Don Stewart, spokesman for Senate Majority Leader Mitch McConnell (R-Ky.), noted that Republicans recently lined up a confirmation vote on a separate nominee, Gayle Smith, for USAID administrator, but couldn’t say when Szubin might move.

Stewart dinged Democrats for “politicizing Paris” with this week’s push on stalled national security nominees.

The Brownback Effect

This is the part where reality comes crashing down:

Lots of numbers in a new statewide survey of Kansas from Fort Hays State University, but here’s the stunner:

Only 18 percent of state residents said they were “very” or “somewhat satisfied” with GOP Gov. Sam Brownback.

Kansas, in case there’s any misunderstanding, is a heavily Republican state.

President Barack Obama, long a punching bag for Republicans, rated higher. Some 28 percent of respondents expressed satisfaction with the Democratic chief executive.

The whole thing with Kansas and Mr. Brownback really is a puzzle; it’s one thing to point out that he is wrecking the state’s finances to the point that schools can’t function, thus observing that there is a reason Kansans are annoyed with their governor. But there is also a twist, that Sunflower State voters already knew most of that when they re-elected Gov. Brownback last year.

Certainly, the numbers are remarkable; Mr. Brownback is so awful, in Kansans’ eyes, that President Obama now suffers less ill will in the Jayhawk Midway Wheat State. To the other, though, the notion of self-inflicted damage asserts itself. Kansans quite literally did this to themselves, and we might make that crass joke, “And we’re all just so proud of them for doing such a super job!” but in truth, no, nobody is proud. Nor is this merely a Kansas thing; the Brownback Way is merely a revival of the supply-side mysticism, the “voodoo” economics, of thirty years ago. And this Republicans would inflict on the nation.

Steve Benen recalls Mitch McConnell, who described the Brownback Way as, “exactly the sort of thing we want to do here, in Washington, but can’t, at least for now”:

“At least for now,” of course, refers to the fact that there’s a Democrat in the White House.

In other words, Kansas’ “experiment” – massive tax breaks, coupled with drastic cuts to public investments – is “exactly” the model Republicans want to impose on the nation. They’re just waiting for a far-right president to work with a far-right Congress, just like Kansas’ far-right governor worked with a far-right legislature.

It really is the strangest thing.

Then again, this is Kansas. They have their priorities.

John T. Bennett: “Deputy Whip Tom Cole, R-Okla., and House Freedom Caucus founding member Mick Mulvaney, R-S.C., did agree on two things. They both see Majority Leader Kevin McCarthy, R-Calif., as the leading candidate to take over as speaker. And they believe a government shutdown will be averted by a stopgap spending bill passed within the next few days.”

Emma Dumain: “Sources confirmed to CQ Roll Call Saturday afternoon that in the event Conference Chairwoman Cathy McMorris Rodgers, R-Wash., makes a play for majority leader, Conference Vice Chairwoman Lynn Jenkins, R-Kan., would look to move up one slot.”

David Eldridge and Matt Fuller“House Speaker John A. Boehner has a word of warning, straight out of the Bible, for fellow Republicans: ‘Beware false prophets’.”

Jordain Carney: “Sen. Bernie Sanders (I-Vt.) said Friday that Speaker John Boehner (R-Ohio) was ‘unable to control’ his party and that his resignation could leave Republicans increasingly ‘out of touch.'”

Cristina Marcos: “Rep. Dennis Ross (R-Fla.) announced late Friday he will run for House majority whip, just hours after Speaker John Boehner (R-Ohio) announced his resignation.”

Mark Meckler: “Ding, dong … John Boehner is gone. Long live the tea party movement.”

Bradford Richardson: “‘Taking care of this leadership issue was a pretty selfless act that Speaker Boehner decided to make a little bit easier for everyone,’ Priebus said told host John Catsimatidis on AM 970 New York on Sunday. ‘I might imagine he would have been able to hang on, but the truth is he’s just not the type of guy to put up with it, so he just said, ‘Forget it, I’ll move on’.'”

Zoë Carpenter (The Nation): “ Let’s get one thing clear about John Boehner: His problem was not that his position on abortion was too liberal.”

David Lawder (Reuters): “Thus far, a serious challenger to McCarthy has not emerged, though some Republican aides said that House Financial Services Committee Chairman Jeb Hensarling is weighing a run. A Hensarling spokesman could not be reached for comment.”

Michael McAuliff, Laura Barron-Lopez, and Sam Stein (Huffington Post): “House Speaker John Boehner may be able to leave office on a high note after meeting the pope and potentially averting another government shutdown. But his abrupt departure has many on Capitol Hill fearing it will leave Congress an even worse, more gridlocked institution.

So … right. Good luck with all that. What makes the challenge seem so daunting, of course, is that everything will be obsolete by the time you get through it all. And there is a pervading notion of futility much akin to John Boehner’s speakership; that we might know what has happened, as well as what is expected to happen, does not mean it will happen. This is your House GOP. Enjoy the show. You know. As much as you can.

The Ted Cruz Show (Pleasant Senate Sunday)

There are a number of things to consider―aren’t there always?―about the weekend dispute between Sen. Ted Cruz (R-TX) and pretty much the rest of his Republican colleagues in the United States Senate. First and foremost, Tierney Sneed brings the latest, in the form of a five-point overview, for the aptly named Talking Points Memo.

The elephant in the chamber, such as it is, however, is the entire question of the Export-Import Bank.

The Ex-Im controversy is, in a word, absurd.

Would you like a few more? How about worthy of ridicule.

Naturally, Mr. Cruz wants in.

A Betrayal

Yesterday, Steve Benen described what he sees as a “silent governing failure” of Senate Majority Leader Mitch McConnell. Following a Huffington Post report that the Senate would, under his leadership, become even less productive and more intransigent about the federal judiciary, Mr. Benen reminded:

Now, some of you are probably thinking this is normal. President Obama’s second term is starting to wind down; the opposition party controls the Senate; so it stands to reason that the GOP majority would scrap plans to confirm qualified court nominees. Perhaps, the argument goes, McConnell is doing exactly what Democrats did when they had a similar opportunity.

It would be a credible argument if it were in any way true.

The Republican (ahem!) “Quandary”

Toss a coin; is the problem the political reporting or the politics? Consider a lede from Jonathan Weisman and Jennifer Steinhauer for the New York Times:

Senate Republicans bolted for a two-week spring recess with the confirmation of Loretta E. Lynch as attorney general in jeopardy, and themselves in a quandary: Accept a qualified nominee they oppose because she backs President Obama’s policies or reject her and live with an attorney general they despise, Eric H. Holder Jr.

See, that’s pabulum. But, to the other, whence comes it? After all, U.S Attorney Loretta Lynch has seen her nomination to succeed Eric Holder as Attorney General languish, though Senate Republicans are hard pressed to come up with a reason.

But, still, really? This is like a children’s book―And then the poor Senator had to choose …―except, come on, it wouldn’t make any sense even to children.

Not Surprising (Lazy Days Delays Mix)

The news shouldn’t be surprising; Senate leadership has once again pushed back any prospect of a confirmation vote for Attorney General nominee Loretta Lynch. The situation as it stands in the wake of reports that mid-April will be the earliest possibility for a vote:

White House Press Secretary Josh Earnest told reporters yesterday, “The continued delay is unconscionable.”

Note, the problem is not that Republicans have imposed a blanket blockade on all confirmation votes. On the contrary, since Lynch was approved by the Senate Judiciary Committee with bipartisan support on Feb. 26, the GOP majority has confirmed four Obama administration nominees, including one yesterday. Republicans have also allowed Defense Secretary Ashton Carter’s nomination to reach the floor, despite the fact that Carter was nominated after Lynch.

But the A.G. nominee, for reasons Republicans have struggled to explain, is being denied an up-or-down vote, even though Lynch appears to have the votes necessary for confirmation.

All of this has unfolded despite Senate Majority Leader Mitch McConnell’s (R-Ky.) public vow that he would allow a vote on Lynch last week – a commitment he has since broken.

As of this morning, Lynch was nominated 136 days ago. As we discussed last week, the first African-American woman ever considered for this post has waited longer for a vote than any A.G. nominee in history, and longer than the last five A.G. nominees combined. Even her fiercest critics have failed to raise substantive objections to her qualifications, background, temperament, or judgment.

What we have here is another example of the Republican thesis that government does not and cannot work. And what we have here is also another example of Republicans trying to prove the thesis by deliberately botching up basic governance.

No, really, how is any of that actually surprising?

It really is something of a mystery:

Remember, Senate Democrats could have tried to rush Lynch through the confirmation process during the lame-duck session late last year – before Dems lost their majority status – but Republicans implored Democrats not to. The power should rest with the incoming majority, GOP senators said.

The outgoing Democratic majority obliged, expecting Republicans to be at least somewhat responsible. After all, there were no substantive objections to Lynch and the GOP was desperate to see Holder go. Republicans had a built-in incentive to act reasonably.

And yet, here we are. Senate Majority Leader Mitch McConnell (R-Ky.) and his team have subjected Lynch to the longest delay of any A.G. nominee in history – for reasons they haven’t even tried to explain – and this week, McConnell even broke his word about bringing Lynch’s nomination to the floor for a vote this week.

The irony is under-appreciated: Republicans wanted Holder to step down, and he did. Republicans wanted Obama to nominate an uncontroversial successor, and he did. Republicans wanted Democrats not to vote on Lynch in the lame-duck session, and they obliged.

Months later, the Senate’s GOP majority can’t quite bring itself to do what Republicans say they want to do. In fact, as far as McConnell & Co. are concerned, they hope to defeat Lynch – again, for reasons they’ve struggled to articulate – raising the prospect of Republicans keeping Holder at his current post until January 2017.

The Senate GOP in Crisis

In a way, everyone else is taking it well. That is to say, even the Iranians are trying very hard to enjoy themselves in the moment, and why not? It is not every day the United States Senate goes out of its way to afford a foreign nation the opportunity to school it on American constitutional issues. Or, as Akbar Shahid Ahmed explains, for Huffington Post:

After sparking a furor in Washington Monday with a letter signed by fellow Republican senators warning Iran against nuclear diplomacy with the Obama administration, Sen. Tom Cotton (R-Ark.) went to the extra trouble of having his message translated into Farsi for Iranian leaders. Among his targets: foreign minister Mohammad Javad Zarif.

Cotton needn’t have bothered with the translation. Zarif is more than capable of reading the Republicans’ letter in English. He attended prep school in San Francisco, San Francisco State University, Columbia University, and the University of Denver’s School of International Studies (where, Zarif told The New Yorker’s Robin Wright, a professor who had taught GOP foreign policy icon Condoleezza Rice once quipped to the young Iranian, “In Denver, we produce liberals like Javad Zarif, not conservatives like Condi Rice.”)

Zarif, leading his nation’s negotiations with the U.S., the U.K., France, Germany, Russia and China, put that education to use in his response Monday to the Republican message, which suggested that Iran’s leaders “may not fully understand our constitutional system.”

Zarif answered that it was Cotton and the 46 other Republican senators who signed his letter who suffered from a lack of “understanding.”

“The authors may not fully understand that in international law, governments represent the entirety of their respective states, are responsible for the conduct of foreign affairs, are required to fulfil the obligations they undertake with other states and may not invoke their internal law as justification for failure to perform their international obligations,” Zarif said, according to Iran’s government-controlled Tasnim News Agency.

He suggested that the Republican warning that a successor to President Barack Obama could undo any agreement with Iran was baseless. Zarif said the “change of administration does not in any way relieve the next administration from international obligations undertaken by its predecessor.”

Yeah. See, it’s one thing to say there is a problem in that Mr. Zarif has a point. But the problem isn’t that an Iranian foreign minister has a point, rather that he needs to make it at all.
