The Conservative Conundrum, and Other Notes

Paul Krugman offers a curious observation:

As many have noted, it’s remarkable how shocked — shocked! — that establishment has been at the success of Donald Trump’s racist, xenophobic campaign. Who knew that this kind of thing would appeal to the party’s base? Isn’t the G.O.P. the party of Ronald Reagan, who sold conservatism with high-minded philosophical messages, like talking about a “strapping young buck” using food stamps to buy T-bone steaks?

Seriously, Republican political strategy has been exploiting racial antagonism, getting working-class whites to despise government because it dares to help Those People, for almost half a century. So it’s amazing to see the party’s elite utterly astonished by the success of a candidate who is just saying outright what they have consistently tried to convey with dog whistles.

We might call it curious not for being obscure, but, rather, for being obvious.

That is to say, despite the blunt force with which reality asserts itself, we are somehow expected to ignore it. The Republican Party, of course, seems very good at ignoring it. Even establishment tools like RedState managing editor Leon H. Wolf are getting in on the act:

Sadly, 35% of our party has decided to abdicate their responsibility as adults to take their civic voting duty seriously, and so the poisonous threat of Trump has completely altered my own personal voting calculus.

And we, too, might try the word, sadly.

Because, sadly, we find ourselves up against a baseline standard that can only break when conservatives need it to; blaming voters, even on those occasions when circumstance otherwise describes it as wholly appropriate, is problematic in the marketplace.

Republican Governance (Aborted)

This is pretty straightforward:

• In 2013, North Dakota Republicans passed into law a heartbeat abortion bill, which would have set the termination cutoff around six weeks.

• The law never went into effect, and was struck in federal court in April, 2014.

• In July, 2015 a federal appeals court affirmed that ruling; the North Dakota anti-abortion law that never went into effect remained struck.

• Today the Supreme Court said no to the Peace Garden (Roughrider? Flickertail?) State’s last appeal; the law remains dead.

This is the only catch: This was how it was supposed to go.

Republicans knew the law wouldn’t survive; Gov. Jack Dalrymple even said so when he signed the bill into law: “Although the likelihood of this measure surviving a court challenge remains in question, this bill is nevertheless a legitimate attempt by a state legislature to discover the boundaries of Roe v. Wade”. Apparently, the governor thought viability was an open question, which would of course be the reason Judge Daniel L. Hovland wrote, in the April, 2014 decision, that, “a woman’s constitutional right to terminate a pregnancy before viability has been recognized by the United States Supreme Court for more than forty years”, reminded that the highest court in the land “has clearly determined the dispositive issue presented in this lawsuit”, and even found himself explaining to North Dakota, “This court is not free to impose its own view of the law”.

So here’s the thing: When Republicans tell you government doesn’t work, what they mean is that government in their own hands does not work.

No, really, just think about it for a minute. (1) Pass a harsh bill that stands well outside accepted norms; (2) argue the new law is a “legitimate attempt” to “discover the boundaries”; (3) pretend in court the boundaries are unclear and need to be discovered; (4) get reminded quite the opposite; (5) appeal to the Supreme Court; (6) see your appeal denied.

This, according to Gov. Dalrymple, was apparently the plan.

No, really, think about the logic here: The Court says we can only go this far. But they didn’t explicitly say we couldn’t go farther. You might as well fault the speed limit signs for every possible velocity they do not explicitly reject: “It only says, ‘Speed Limit 55’; it doesn’t explicitly say, ‘Thou shalt not drive ninety miles per hour’!”

When Republicans tell us government does not work, it would behoove us to attend the threat.

How can anybody possibly resist that quote?

No, really, until Rep. Paul Ryan (R-WI01) makes some sort of move, either bowing to pressure or finding some other way to silence the groveling, this would appear to be the holding pattern. Paul Kane and Robert Costa peruse the tea leaves, and perhaps the next best indicator of what’s going on is another marvelous quote from their effort for Washington Post:

“There is a story in ‘The Book of Virtues’ called ‘Boy Wanted,’ ” said William J. Bennett, a former education secretary in the Reagan administration and a mentor to Ryan. “Boys want him; girls want him. That’s what’s happening to Paul. He also has a sense of duty to his family, to the things he knows, like the Ways and Means Committee.”

Yeah, good luck with that one.

An Indictment in Texas

It really is a strange tale, one notable not so much for public corruption or the fact of it being a Texas Republican, but rather for its bizarre dimensions, the twenty-first century imagining a dystopic marriage of convenience ‘twixt Mack Sennet and Rube Goldberg.

Or something like that. Sam Levine brings the update for Huffington Post:

Texas Attorney General Ken Paxton (R) has been indicted by a grand jury, multiple outlets reported on Saturday.

The indictments were handed down on Tuesday and will be unsealed Monday. Paxton faces three felony charges: two counts of first-degree securities fraud and a third-degree charge of failing to register with the state securities board ....

So, yeah. That’s going on.

Oklahoma Governance

There are days, you know, when it is really easy to pick on an idea. Take Oklahoma for instance. Last week we learned about the strangeness of Oklahoma virtue, and then a spokesman for Gov. Mary Fallin (R) found himself blaming Texas for protests in Durant and Oklahoma City demonstrating support for the Confederacy as President Obama arrived.

Talk about a trifecta; this also happened:

Gov. Mary Fallin (R) and the GOP-led legislature announced they’re prepared to ignore the state Supreme Court, at least for now, while they consider new solutions.​

The Republican governor talked to reporters, saying roughly what you’d expect her to say: she’s “disappointed” with the court’s decision; she thinks they made the wrong call; etc. But as KFOR, the NBC affiliate in Oklahoma City, reported, Fallin added one related thought that wasn’t expected at all:​

Gov. Fallin said she believes the final decision on the monument’s fate should rest with the people.​

“You know, there are three branches of our government. You have the Supreme Court, the legislative branch and the people, the people and their ability to vote. So I’m hoping that we can address this issue in the legislative session and let the people of Oklahoma decide,” she said.​

The KFOR report added, “Despite what the governor said, the three branches of government include the legislative, executive and judicial branches” ....​

.... We can certainly hope that Fallin, a former multi-term member of Congress, knows what the three branches of government are. Indeed, in Oklahoma, she’s the head of one of them – the one she left out this week.​

This is actually one of the big differences. Look, Democrats might well be just as middling, mincing, and incompetent as they seem, but, to the one, to the one, it’s nothing comparable to this, and, to the other, ritual equivocation would only obscure important considerations.

The Bobby Jindal Show (Fake Super Funtime Sneak Pak Preview Peek Pass)

This takes a bit of work. Just a little, but, you know, still. Sorry. The hard part is trying to wrap your head around the idea that this is somehow real. Let us then start earlier this week. Jordan Weissmann of Slate picks up the tale:

While Kansas has become a strictly tragic cautionary tale about what happens when a politician actually tries to govern in line with radical conservative tax dogma, Louisiana is turning into more of a dark comedy. Coming into this year, the state was facing a $1.6 billion budget shortfall. Unfortunately, Gov. Bobby Jindal—America’s spirit of hopeless presidential ambition incarnate—had signed Grover Norquist’s pledge not to raise any taxes. This left lawmakers in a bit of a bind, since cutting their way to fiscal health would have meant decimating public health or higher education funding.

Last week, however, legislators ultimately passed a budget that raised hundreds of millions of dollars in new revenue, sparing hospitals and colleges. Better yet, Jindal says he’ll sign it. So, how’d they square this circle?

With a mind-numbing budget gimmick, of course ....

.... Jindal created a fake fee for students, and a fake tax credit to balance it out, which ultimately leads to no money changing hands, but apparently satisfies whatever agreement Jindal struck with Norquist to preserve the illusion that he didn’t raise taxes. “It’s an embarrassing bill to vote for,” one Republican state representative told the New York Times, demonstrating the sort of candor that only becomes possible once your own party’s governor has alienated the vast majority of his state and abandoned all pretense of rational policymaking in pursuit of an inevitable also-ran performance in the GOP primary.

It really is futility. The Hopeless Clown has yet to officially jump into the race, but it has been clear to many that his mind isn’t on his work as Pelican State executive. When last we checked behind the scenes of the Bobby Jindal Show, the governor was posing for the national stage, hoping to enact a high profile bill by executive order after the legislature said no.

But wait … there’s more!

A Betrayal

Yesterday, Steve Benen described what he sees as a “silent governing failure” of Senate Majority Leader Mitch McConnell. Following a Huffington Post report that the Senate would, under his leadership, become even less productive and more intransigent about the federal judiciary, Mr. Benen reminded:

Now, some of you are probably thinking this is normal. President Obama’s second term is starting to wind down; the opposition party controls the Senate; so it stands to reason that the GOP majority would scrap plans to confirm qualified court nominees. Perhaps, the argument goes, McConnell is doing exactly what Democrats did when they had a similar opportunity.

It would be a credible argument if it were in any way true.

A New Way of Doing Things

“Of course, in the American tradition, the idea of elected American officials trying to sabotage American foreign policy, on purpose, brazenly undermining our nation’s attempts at international leadership, seems plainly ridiculous. But in 2015, it’s become an increasingly common Republican tactic.”

This is not a good sign:

Sen. James Inhofe (R-Okla.), one of the nation’s most aggressive climate deniers and the man Senate Republicans chose to lead the Senate committee on environmental policy, wasn’t subtle when describing his sabotage ambitions.

“The Tom Cotton letter was an educational effort,” Senator Snowball told the WSJ.

It is impossible to state with appropriate gravity the strangeness of the #GOP47; this really was, once upon a time, out of bounds. And it is, at the very least, foolhardy, if not downright dangerous. The difference between the two is up to voters; if this is the what they expect of governance, the marketplace will respond, and this will be how foreign policy goes. To the other, if this really is as worrisome to Americans as many seem to think it should be―and, yes, that includes the triune staff of This Is (Me, Myself, and I, as the old Gilligan’s Island joke goes)―what will Americans say when a Republican is in office and Democrats are trying to stymie some foreign policy initiative? Is this the way it will go, or will Democrats be expected to play by obsolete rules that will cost them at the ballot box and, as a result, cost everyone else in terms of policy resolution?

If it was good enough for Bush when he negotiated our exit from Iraq, then it is good enough for Obama trying to negotiate against a future nuclear war, or simply haggle over clean air. When Republicans appeal to some version of common sense―should the Senate have a say in this or that?―remember the standard they are appealing against. There is an unfortunate appearance in American politics and governance that we only get around to certain assertions of the right thing when there are other complicating issues. There are plenty who rightly wonder if the president’s skin color is what inspires Republican hatred. Others might suggest that the GOP has simply run out of tricks in opposition to a Democratic president at a time that interrupts their effort to build a warring New American Century. Regardless, however, of what leads to such conservative lunacy, Republicans need to knock it the fuck off.

And, quite frankly, American voters need to make that point. Out in Washington state, Democrats held a supermajority for years, and generally refused to use it; this conforms to an older political model by which such strongarming is considered unseemly. In the face of conservative bullying, however, it has long been a question whether or not this is an appropriate resolution for the question. As Republicans grow their game, perhaps we might look upon Democratic incompetence as a series of opportunities lost for the sake of some dignity that voters don’t give a damn about anymore. In the end, two state Senate Democrats rolled, handing the chamber to Republicans, and once again our sense of obligation―say, funding the schools to meet constitutional requirements―is brought into question as an issue of whether or not it is worth fulfilling those commitments. That is to say, given a chamber to control in our state government, Republicans returned the discussion to whether or not it is financially worth obeying the law.

Perhaps state Democrats should have used their supermajority.

Nonetheless, what will the American people say if Democrats, under a Republican presidential administration, return the favor?

Don’t want them to do that? Then don’t ask them to.

Not Surprising (Lazy Days Delays Mix)

The news shouldn’t be surprising; Senate leadership has once again pushed back any prospect of a confirmation vote for Attorney General nominee Loretta Lynch. The situation as it stands in the wake of reports that mid-April will be the earliest possibility for a vote:

White House Press Secretary Josh Earnest told reporters yesterday, “The continued delay is unconscionable.”

Note, the problem is not that Republicans have imposed a blanket blockade on all confirmation votes. On the contrary, since Lynch was approved by the Senate Judiciary Committee with bipartisan support on Feb. 26, the GOP majority has confirmed four Obama administration nominees, including one yesterday. Republicans have also allowed Defense Secretary Ashton Carter’s nomination to reach the floor, despite the fact that Carter was nominated after Lynch.

But the A.G. nominee, for reasons Republicans have struggled to explain, is being denied an up-or-down vote, even though Lynch appears to have the votes necessary for confirmation.

All of this has unfolded despite Senate Majority Leader Mitch McConnell’s (R-Ky.) public vow that he would allow a vote on Lynch last week – a commitment he has since broken.

As of this morning, Lynch was nominated 136 days ago. As we discussed last week, the first African-American woman ever considered for this post has waited longer for a vote than any A.G. nominee in history, and longer than the last five A.G. nominees combined. Even her fiercest critics have failed to raise substantive objections to her qualifications, background, temperament, or judgment.

What we have here is another example of the Republican thesis that government does not and cannot work. And what we have here is also another example of Republicans trying to prove the thesis by deliberately botching up basic governance.

No, really, how is any of that actually surprising?

When Loretta Lynch, nominee to replace Eric Holder as Attorney General, appeared before the Senate Judiciary Committee, the Republican majority seemed less interested in her record as an attorney and more focused on complaining about the man who would be her predecessor. And this, of course, after Republican efforts during the last session to block her nomination. Yesterday, things took a turn for the strange―

Yesterday, the GOP strategy became clearer. McConnell seems to have kept things vague because he intended to break his word.

Senate Majority Leader Mitch McConnell says there’ll be no vote to confirm Loretta Lynch as attorney general until Republicans and Democrats resolve a dispute over a human trafficking bill.

“If they want to have time to turn to the attorney general,” then “we have to finish the human trafficking bill,” McConnell said Sunday on CNN’s “State of the Union.”

The Majority Leader added that he “had hoped” to allow the Senate to vote on Lynch, whose nomination has, by most measures, already waited longer than any other A.G. nomination in American history, but Lynch “will be put off again” unless Democrats agree to pass the human-trafficking bill that stalled last week.

McConnell went on to say, “We have to finish the human trafficking bill. The Loretta Lynch nomination comes next.”

Benen - GOP Ransom NoteJust so we’re clear, there’s no procedural concern or rule that must be followed. McConnell could bring Lynch’s 128-day wait to an end this morning, and by all appearances, she’d have the votes necessary to be confirmed.

―which, admittedly, sounds about par for the course in terms of Republican governance. The point here is the same as it has always been, to govern by ransom. The underlying argument here is that Republicans refuse to undertake their basic obligations unless they are given extra rewards. Give them treats, or the nation will suffer.

Benen noted yesterday:

And what of the human-trafficking bill? That was a bipartisan proposal, set to clear the chamber 100 to 0, but Republicans quietly added an anti-abortion provision and neglected to mention it to the Democratic co-sponsors. Dems, feeling betrayed and opposing the add-on, have decided to withdraw their support for the bill until the GOP majority takes the provision out.

Riders have always been notorious, but of late Republicans have taken this practice to odius extremes.α

As Benen reports today, the White House has sounded off on the Majority Leader’s stupidity:

From the White House podium, press secretary Josh Earnest is usually pretty circumspect in his criticisms of lawmakers. Yesterday, however, President Obama’s spokesperson was far less guarded – the Senate Republicans’ handling of Loretta Lynch’s Attorney General nomination, and their willingness to connect this to an unrelated human-trafficking bill, was just too much for Earnest.

“You’ve got to hand it to Republicans, that they’ve taken even a measure as common sense as [combating human trafficking] and turned it into a partisan controversy.

“That is not a reflection of a flaw in the bill. It’s a reflection of inept leadership”....

.... For his part, McConnell told reporters yesterday that the previous Senate Democratic majority could have voted on Lynch during last year’s lame-duck session, but they didn’t, delaying the vote until the new Congress. McConnell “failed to point out that that delay was at his request,” the president’s spokesperson reminded reporters yesterday.

And as hard as it seems to believe, this sort of dishonesty and irresponsibility is apparently what our Republican-voting neighbors want. But, you know, just like Sen. Embry, it’s not their faults.

Kentucky? imagine that!―where Adam Beam reported on an episode in which a group of high school students managed to get a bill into serious consideration before the state house. The bill would have allowed student committees to participate in the screening of candidates for superintendent, and appeared to be on its way to easy passage. Then state Sen. C.B. Embry (R-KY06) tacked on an amendment demanding schools discriminate against transgender students. Another amendment would empower religious supremacism and discrimination. The bill is now left in limbo because the Kentucky House is wary of what happens next. As to Sen. Embry? “It’s not my fault,” he explained. And why would it be? He’s just a Republican, and they are never at fault for their own actions, and thus should never be held accountable.
